DMCA Policy

This document explains how to report copyright infringement and how counter-notices are handled.

This policy applies to Jovie Technology Inc. ("Jovie", "we", "us").

Our Commitment

Jovie respects the intellectual property rights of artists, creators, and rights holders. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid notices of alleged copyright infringement.

Designated Agent

Our designated agent for receiving DMCA notices is:

Filing a Takedown Notice

If you believe that content on Jovie infringes your copyright, you may submit a takedown notice to our designated agent. Your notice must include:

  1. Identification of the copyrighted work you claim is infringed
  2. Identification of the material on Jovie that you claim is infringing, with enough detail for us to locate it (e.g., the profile URL)
  3. Your contact information (name, address, phone number, email)
  4. A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  6. Your physical or electronic signature

Send your notice to legal@jov.ie with the subject line "DMCA Takedown Notice."

Our Response

We will acknowledge receipt of valid DMCA notices within 2 business days and take action within 10 business days. Actions may include removing or disabling access to the allegedly infringing material.

We will notify the user who posted the content that a takedown notice has been received and provide them with the opportunity to file a counter-notice.

Counter-Notice

If you believe your content was removed in error or is not infringing, you may submit a counter-notice to legal@jov.ie containing:

  1. Identification of the material that was removed and the location where it appeared before removal
  2. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  3. Your name, address, and phone number
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or San Francisco County, California, if outside the United States)
  5. A statement that you will accept service of process from the person who provided the original takedown notice
  6. Your physical or electronic signature

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the removed material.

Repeat Infringer Policy

Jovie maintains a policy of terminating accounts of users who are repeat infringers of copyright. We track takedown notices and may terminate accounts after two or more valid, uncontested notices.

Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
